Welcome to Their Story Lives. These Terms of Service ("Terms") govern your use of our website, applications, and services (the "Service"). By using the Service, you agree to these Terms.
Quick Summary: We help your family honor and preserve the stories of the people you love. You agree to use the Service respectfully, and we agree to protect your family's memories and privacy.
1. Acceptance of Terms
By accessing, browsing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund and Cancellation Policy. If you do not agree, you may not use our Service.
These Terms apply to all users, including visitors, family members, invited guests, registered users, paying customers, and partners. If you use our Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service

We may modify, update, or discontinue features at any time and will provide reasonable notice of material changes.
3. Account Registration and Security
You agree to provide accurate information, keep it current, and keep your sign in details confidential. Passwords must be at least 8 characters and include an uppercase letter, a number, and a special character. Sign in may require a code sent to your email; please check your spam folder.
You are responsible for all activity under your account. Do not share your credentials, create accounts to get around limits, or impersonate others. Notify us immediately of any unauthorized access.
4. Authority Over a Loved One's Memorial
By creating a memorial or tribute, you confirm that you are a family member or are authorized by the family to do so. If family members disagree about a memorial, we may pause or limit changes until the family resolves the matter. We are not responsible for resolving family disputes.
5. Acceptable Use and Content Standards
You agree to use the Service respectfully and lawfully. You may not harass others, upload malware, send spam, attempt unauthorized access, scrape data, or misuse the Service commercially.
Content you upload must not be illegal, offensive, defamatory, or include others' private information or copyrighted material without permission. We may remove content that violates these Terms.
6. Guest Uploads and Family Contributions
Friends and family may be invited to share photos, videos, and messages. Guest contributions remain pending until the family approves them, and the family may decline or remove any contribution. Guests confirm they have the right to share what they upload.
7. Music, Photos, and Copyright
You are responsible for having the rights to photos, music, and recordings you provide. Copyrighted commercial music may not be used without permission. We may suggest licensed music styles instead.
8. Intellectual Property
The Service, its design, software, and branding belong to Their Story Lives and are protected by law. You may not copy, reverse engineer, or use our trademarks without permission.
You keep ownership of the stories, photos, and recordings you create. You grant us a limited, non exclusive, royalty free license to host, store, back up, display, and format your content only as needed to provide the Service to you and the people you choose. This license ends when you delete your content or close your account, except for content you have already shared with others.
9. Privacy, Sealed Entries, and the Password Keeper
Your privacy is important to us. You decide who can see each story, photo, and recording. Our Privacy Policy explains how we collect and protect your information.
Passwords and secrets stored in the Family Vault are encrypted, and viewing them requires re entering your sign in password. Sealed entries are released only as you direct. Estate and legal documents are stored privately and shared only with people you approve. No method of storage is 100% secure.
10. AI Features, Calls, and Text Messages
Some features use artificial intelligence, such as interview calls, story writing tones, translations, and voice narration. AI output may contain mistakes; please review it before sharing. Interview calls may be recorded to create your story.
Text Messages
If you choose to receive text messages, we may send texts about your account, family event reminders, memorial updates, appointments, and billing notices. Message frequency varies. Message and data rates may apply.
You have the right to stop receiving text messages at any time. Reply STOP to unsubscribe or HELP for assistance. Choosing not to receive text messages will never affect your ability to use the Service. Consent is not a condition of purchase.

12. Independent Certified Story Advisors
Certified Story Advisors and Referral Partners are independent business owners, not employees or agents of Their Story Lives. They may not make promises on our behalf beyond what is stated in these Terms.
13. Third Party Services
We rely on trusted providers for payments, email, calls, storage, and printing. Their services are governed by their own terms, and we are not responsible for their outages or actions.
14. Children
Accounts must be created by adults 18 or older. Parents or guardians may add and manage profiles for children in their family and are responsible for that content.

16. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available," without warranties of any kind, including merchantability, fitness for a particular purpose, or uninterrupted operation. We encourage you to keep your own backup copies using the download tools we provide.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or loss of profits or data. Our total liability for any claim shall not exceed the amount you paid us in the 12 months before the claim.
17. Indemnification
You agree to defend, indemnify, and hold harmless Their Story Lives from claims, damages, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms or others' rights, or content you upload.
18. Termination
You may close your account at any time. You may download your content before closing. After closing, your data may be deleted after a reasonable period.
We may suspend or terminate accounts that violate these Terms, fail to pay, or put the Service or other users at risk, or when required by law. We will give reasonable notice unless immediate action is needed for security or legal reasons.
19. Dispute Resolution
These Terms are governed by the laws of the State of Arizona. Any disputes will be resolved in the state or federal courts located in Maricopa County, Arizona. Before filing any legal action, you agree to contact us first so we can try in good faith to resolve the matter informally.
20. Language
These Terms may be offered in English and Spanish. If there is any difference between versions, the English version controls.
21. Changes to Terms
We may update these Terms. We will notify you by email or a notice on the Service, and changes take effect 30 days after notice. Continued use means you accept the updated Terms.
22. General Provisions
These Terms, with our Privacy Policy and Refund and Cancellation Policy, are the entire agreement between you and Their Story Lives. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We are not liable for delays caused by events beyond our reasonable control.
